1. 15 minute Observation Period Not Adhered to –
In some states, the standard procedure an officer follows in cases of
drunk driving is to hold the suspect for 15 minutes prior to
administering a breathalyzer test. This observation period allows the
officer to observe symptoms of drunkenness such as burping, vomiting, or
slurred speech. If you can provide evidence that the officer was not
paying attention to your behavior during this period, you can use this
to help beat your DUI case.
2. Officer Not Credible – Officer credibility
can play a huge factor with regards to the validity of your DUI. If
the officer who pulled you over has had disciplinary action against
him in the past, this can be a red flag as to his credibility.
